1. Introduction
These terms and conditions govern your use of services from Outstanding Digital Marketing available at Outstanding Digital Marketing. By engaging our services, you agree to comply with these terms.
2. Services Offered
We offer digital marketing services including, but not limited to:
- Social Media Management
- SEO (Search Engine Optimisation)
- Google Ads Management
- Email Marketing Campaigns
- Content Creation & Copywriting
All services are provided according to the package selected, details of which can be found on our website.
3. Packages and Pricing
Our packages—Starter, Grow, and Thrive—each offer varying levels of service to meet the needs of different businesses. Pricing for each package is available on the website, and all prices include applicable taxes.
4. Terms Specific to Each Package
- No Minimum Service Period: Services are provided for the period you have paid for, without a required minimum term.
- Cancellations: Cancellations must be made at least 2 days before the next billing cycle to avoid charges for the following period.
- Suggested Commitment: For optimal results, certain services suggest a commitment of at least 3 months, though this is not required.
5. Payment Terms
All payments are made monthly in advance via direct debit from the credit card you submit. Invoices are issued at the start of each month, and payment is processed automatically.
- Refunds: Refunds are not provided for services already rendered. If you wish to cancel, please ensure that cancellations are made in line with the terms specified above.
- Late Payments: If payment is not successfully processed, services may be suspended until payment is received.
6. Client Responsibilities
As a client, you are responsible for:
- Providing all necessary assets (e.g., logos, brand materials) within the agreed timeframe.
- Reviewing and approving applicable content within 3 days.
- Ensuring that all materials provided do not infringe on third-party rights.
Failure to provide assets or approvals on time may lead to delays in service delivery.
7. Confidentiality and Intellectual Property
All content created by Outstanding Digital Marketing is transferred to the client upon full payment. However, proprietary processes and templates used remain the intellectual property of Outstanding Digital Marketing.
We agree to keep all client information confidential, except where disclosure is required by law.
8. Limitation of Liability
Outstanding Digital Marketing is not responsible for indirect or consequential damages that may arise from the use of our services. We are also not liable for issues that occur on third-party platforms (e.g., Google, Facebook).
In any case, liability is limited to the fees paid by the client in the three months preceding the claim.
9. Termination of Service
Either party may terminate services with 2 days’ notice. Upon termination:
- Any outstanding balances must be settled.
- All services will be stopped, and unused services forfeited.
Outstanding Digital Marketing reserves the right to terminate the agreement if terms are violated.
10. Fraudulent Chargeback Policy
Any fraudulent chargeback requests made via your bank or financial institution will result in the immediate termination of services. In such cases, Outstanding Digital Marketing reserves the right to retain all intellectual property rights over the works produced and remove any already published works. This includes content created during the period of service that remains unpaid due to the chargeback.
